For professionals exploring EB-2 NIW, a USCIS guidance update issued on January 15, 2025 clarified how officers assess eligibility and supporting evidence. The update applied immediately to requests pending or filed on or after that date. This article explains that dated update alongside the current USCIS Policy Manual; it is not a new policy announcement.
EB-2 eligibility comes before the NIW
USCIS first checks whether a petitioner qualifies for the underlying EB-2 classification through an advanced-degree professional route or exceptional ability. Requesting a national interest waiver does not remove that requirement.
For the advanced-degree route, the occupation connected to the proposed work must qualify as a profession. Applicants relying on a bachelor's degree plus five years of progressive experience must show that the post-degree experience is in the relevant specialty. For exceptional ability, the claimed expertise must connect directly to the proposed endeavor.
Your proposed work needs a specific explanation
The Policy Manual distinguishes a job title from an endeavor. Saying you are an engineer or entrepreneur is not enough: explain the particular work you plan to undertake and its potential impact.
USCIS assesses whether that endeavor has substantial merit and national importance, whether you are well positioned to advance it, and whether waiving the job-offer and labor-certification requirements would benefit the United States overall. Working in an important industry does not, by itself, establish national importance.
Build evidence around the work you propose
The January update also addressed how USCIS evaluates support letters and business plans. The current manual points to relevant achievements, progress, a detailed plan, and interest from potential users, customers, or investors when assessing whether someone can advance an endeavor.
A practical preparation step is to connect each supporting document to a specific claim about your qualifications, proposed work, or progress. Avoid relying on broad praise or unsupported projections.
The takeaway for US immigration applicants: EB-2 eligibility and the national interest waiver are separate assessments. Strong credentials alone do not guarantee NIW approval.
